Bargaining Update - CANSA Tentative Agreement

 

CANSA and Nav Canada have reached a Tentative Agreement.

 

Your Bargaining Team is proud to present a Tentative Agreement that the Membership can vote on. The Bargaining Team strongly believes this is an agreement that all of the CANSA Membership will benefit from. The tentative agreement highlights are listed below. Please note these are only settlement highlights.

Ratification Tour


I will be visiting each Unit to hold a Ratification Meeting to answer any questions you may have on the tentative agreement with Nav Canada. Times and location will be determined by your local RVP. The scheduled dates will be as follows:

 

  • Winnipeg – December 2

  • Vancouver – December 4

  • Edmonton – December 6

  • Toronto – December 9

  • Ottawa – December 9 (2PM via conference call)

  • Montreal – December 11

  • Moncton – December 13

  • Gander – December 16

 

Voting will open following the Ratification Meeting at each site using Simply Voting through your personal email.  Voting will close at 1700 EST on December 30, 2024.

Tentative Agreement Highlights

 

The existing provisions of the current collective agreement are subject to the following amendments:

 

1.     DURATION

 

·      July 1, 2023, to June 30, 2028

 

2.     WAGES AND PREMIUMS

 

·      The following increases will be applied to salaries and all premiums and allowances described in Articles 31.01 – Evening Shift Premium, Article 31.02 – Midnight Shift Premium, Article 31.03 – Weekend Premium, Article 35.01 – Standby, Article 28.09 – On the Job Training and LOU No. 7 – OTS Modified Work Schedule:

 

o   Effective July 1, 2023: 4.5% increase

o   Effective July 1, 2024: 4% increase

o   Effective July 1, 2025: 3.5% increase

o   Effective July 1, 2026: 3% increase

o   Effective July 1, 2027: 3% increase

 

 

·      Addition of one (1) increment at the end of all grades.  Employees who have been at the top increment for more than twelve (12) months shall move to the new increment effective July 1, 2023. All other employees shall maintain their anniversary date.

 

o   Employees who do not move to the new increment added at the end of all grades on July 1, 2023, as per the above will receive a one-time non-pensionable lump sum payment equivalent to 3% of their new annual salary as of date of ratification.

 

·      Increase of weekend shift premium to six dollars and fifty cent ($6.50) per hour, with general wage increases applied effective July 1, 2024, July 1, 2025, July 1, 2026, and July 1, 2027.

 

·      Retroactive payments on wages and premiums will be made only to current employees as of the date of ratification of the new collective agreement. Employees who have retired, resigned, been terminated or otherwise left the employment of Nav Canada since July 1, 2023, shall not be eligible for retroactive payments.

 

3.     PAY ADMINISTRATION

 

·      Revisions to Article 28.03 – Pay Administration removing reference to performing duties of a higher classification level for a period of two (2) days and removing Article 28.04 – Additional Responsibility Premium so that all time performing duties at a higher classification are paid at the appropriate rate.

 

4.     CAREER DEVELOPMENT LEAVE WITH PAY

 

·      Addition of Article 26.04 – Career Development Leave for Management Development Assignments adding a longstanding Letter of Understanding (LOU) into the body of our collective agreement.

 

5.     SHIFT PREMIUMS

 

·      Period for evening shift premium adjusted to period between 16:00 and 22:59 and the period for the midnight shift premium adjusted to the period between 23:00 and 08:00.

 

6.     STAFFING

 

·      Revisions to Article 39 – Staffing and deletion of Letter of Understanding No. 13 – National Bid Trial.

o   National Bids reverted to Transfers with changes.

o   Addition of OTS priority language on ATOS competitions.

o   Removal of ATT-4 seniority bidding.

o   Addition of three (3) year minimum in substantive position to apply on competitions.

 

7.     PENSION PLAN

 

·      Deletion of Article 46.04 (b) from the collective agreement ($2,000 lump sum non-pensionable payment) for employees hired on or after the effective date of ratification.

 

8.     LETTER OF UNDERSTANDING NO. 7 - OTS MODIFIED WORK SCHEDULE

 

·      Revisions to LOU No. 7

o   Removal of cap.

o   Increase OTS Evening Premium to twelve dollars and fifty cents ($12.50) on July 1, 2023, with general wage increases applied effective July 1, 2024, July 1, 2025, July 1, 2026, and July 1, 2027.

o   Nav Canada and CANSA agree to meet on a National Level on an annual basis to discuss OTS work between 6:00 PM and 12:00 AM.

 

·      Addition of new LOU setting out regular consultation between Nav Canada and CANSA on work schedules for OTS at the local level.

 

9.     STAFFING IN ATS LEARNING

 

·      For the duration of this Agreement, CANSA shall support NAV CANADA’s use of a third party to increase its training capacity as it relates to Initial Training.

·      There will be no reduction in the number of permanent CANSA positions in ATS Learning as a result of this supplemental work.

 

·      The Company agrees to maintain a combined minimum of one hundred and ten (110) permanent OTS and OTS Supervisor positions, on a national basis, for the duration of this LOU.

 

10.  LEAVE

 

·      Addition of National Day for Truth and Reconciliation.

·      Improvements to Bereavement Leave.

·      Addition of LOU for Leave with Pay for Loss of Pregnancy.

 

11.  SCHEDULING

 

·      Increased number of days in advance that schedules need to be posted from fifteen (15) days to thirty (30) days.

 

12.  END OF CAREER TRIAL

 

·       End of Career Trial renewed with the required notice increasing from six (6) to twelve (12) months.
