Maintenance of Activity Agreement (MOAA) Update

 

As stated in a previous bulletin, we filed with the Canadian Industrial Relations Board (CIRB) for them to rule on our Maintenance of Activity Agreement (MOAA) with Nav Canada. Both CANSA and Nav Canada had until Wednesday May 15, 2024, to submit their stance on what jobs should be deemed essential to meet the immediate safety threat threshold. Eric and I have worked with the Unifor National Legal Department extensively to complete our full submission to the CIRB which was submitted last Wednesday.

 

Nav Canada and CANSA now have until May 31, 2024 (extended from May 27, 2024), to respond to each other’s submission. We will continue to work with the Unifor National Legal Department on our response to the board. The board with then begin the process of assessing the data. They will take oral arguments from both parties on their stances in order to gather information to make a decision. They will then assess the information and issue an MOAA for Nav Canada and CANSA. There is no timeframe for them to complete the MOAA once they have all the information in hand.

 

 

Strike Mandate Update

 

A strike mandate is only good for sixty days. Our current strike mandate will expire June 9, 2024. I will not be running another strike mandate vote until we have an MOAA and will be in a position to use the mandate should we need to. This will save us from having to do a vote every 60 days until we are in a position to take job action.

 

It is important to remember that a strong strike mandate makes a statement to Nav Canada. 95% demonstrated that the membership is serious about attaining a fair collective agreement and showed Nav Canada the solidarity that the CANSA membership has. Black Shirt Thursday was another demonstration that showed solidarity not only within the CANSA membership but also that we are supported by other bargaining units.

 

We are One Company. Nav Canada needs to treat everyone the same.
